We operate the website https://ptsai.ai and any related products and services that refer or link to these Terms.

1. Acceptance of Terms

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Changes to Terms

We reserve the right to modify these Terms at any time. If we make changes, we will revise the "Last Updated" date at the top of this page. Your continued use of the Services after any changes constitutes your acceptance of the new Terms.

3. Eligibility

You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you meet this eligibility requirement.

4. User Responsibilities

You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

5. Prohibited Activities

You agree not to engage in any of the following:

Violating any applicable laws or regulations, including the TCPA, CAN-SPAM Act, or any applicable state telemarketing laws
Sending unsolicited messages or calls to individuals who have not provided prior express written consent
Impersonating any person or entity or misrepresenting your affiliation with a person or entity
Transmitting any harmful or malicious code, viruses, or malware
Engaging in any activities that disrupt or interfere with the Services
Using our platform to send prohibited content including but not limited to: illegal substances, adult content, hate speech, or misleading financial offers

6. SMS Terms & Conditions — A2P Messaging

Consent to Receive Messages

By submitting your phone number on our website, checking the SMS consent box, or otherwise providing your mobile number to PTS AI, you expressly consent to receive text messages from PTS AI sent via automated systems, including A2P 10DLC registered numbers.

Types of messages you may receive:

Demo scheduling confirmations and reminders
Appointment and calendar notifications
Service updates and onboarding communications
Follow-up messages related to your inquiry
Customer support responses

Example messages:

"Hi [Name], this is Billy from PTS AI. Your demo is confirmed for [Date] at [Time]. Reply STOP to opt out or HELP for assistance. Msg&data rates may apply."

"[Name], thanks for your interest in PTS AI. Our team will reach out shortly to schedule your call. Reply STOP to opt out."

"Reminder: Your PTS AI call is in 1 hour with [Rep Name]. Questions? Reply to this message. Reply STOP to cancel."

Message frequency: Message frequency varies based on your interactions with us and your stage in the onboarding process.

Message and data rates may apply. Contact your wireless provider for details about your plan.

To opt out: Reply STOP to any message at any time. You will be removed immediately and will receive a one-time confirmation. After that, no further messages will be sent.

Carriers are not liable for delayed or undelivered messages.

PTS AI does not sell, rent, or share your mobile number, SMS opt-in data, or SMS consent with any third parties or affiliates for marketing or promotional purposes.

7. Voice & AI Calling Terms

PTS AI provides AI-powered outbound calling services to businesses. If you are an end recipient of an AI call placed through our platform:

The call is placed on behalf of a business that has obtained your prior consent
Calls may be recorded for quality assurance and compliance purposes
You may opt out of future calls at any time by saying "Stop," "Remove me," or a similar phrase during the call
All calls comply with applicable TCPA regulations and FCC guidelines

If you are a business customer using the PTS AI platform to place calls, you represent and warrant that:

You have obtained prior express written consent from all call recipients as required by the TCPA
You have a current and compliant Do-Not-Call (DNC) list and honor all opt-out requests
You will not use the platform to call numbers on the National DNC Registry without proper exemptions
Your calling practices comply with all applicable federal, state, and local laws

8. Intellectual Property

All content, trademarks, and other intellectual property rights associated with our Services are owned by PTS AI or our licensors. You may not use, reproduce, distribute, or create derivative works of any content without our express written permission.

9. Termination

We may suspend or terminate your access to our Services at any time, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Services will immediately cease.

10. Disclaimers

Our Services are provided on an "as-is" and "as-available" basis. We make no representations or warranties of any kind, express or implied, regarding the operation of our Services.

11. Limitation of Liability

To the fullest extent permitted by law, PTS AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Services.

12. Indemnification

You agree to indemnify and hold harmless PTS AI, its affiliates, and their respective officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, or expenses arising out of or related to your use of the Services or your violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law principles.
